Commenting on the prospect of DOJ and the House defending Rep. Brooks's actions as falling within the scope of his employment as a congressman, Phil Andonian told the National Law Journal “Are they really going to claim that spreading provably false claims of election fraud and inciting a deadly riot that endangered all of his colleagues while they were performing their constitutional duties was conduct falling within the scope of Brooks’ employment? Is there any employer on planet earth that would make such an outrageous claim about an employee acting in such a way? We certainly hope not.”
